LMIA Types and Application Requirements

Canadian employers are required to obtain a Labour Market Impact Assessment (LMIA) to get approval to hire foreign workers, unless they qualify for an exemption. The LMIA process allows employers to demonstrate that they cannot fill certain positions locally. If successful, they receive a positive LMIA decision.
 
This positive LMIA decision, also known as an LMIA confirmation letter, serves as an "agreement" between the employer and the government, outlining the terms and conditions for hiring foreign workers.
  • Employer Eligibility Requirements

    To obtain a positive Labour Market Impact Assessment (LMIA), a company must meet the following basic requirements:


    • Operate as a business that provides goods or services to the public in Canada.

    • Demonstrate a genuine need to fill a vacancy with foreign workers due to a local shortage and the reasonable requirements of the business.

    • Be capable of fulfilling all terms of the job offer extended to foreign workers.

    • Have not laid off local employees in the same occupation within the twelve months preceding the application.

    • Have no outstanding compliance issues.

    • Adhere to the terms of any previous LMIAs.


  • Types of LMIA Streams

    If a business meets the minimum eligibility criteria, the next step is to select the most suitable LMIA stream for application.


    Each stream has its own specific requirements or exemptions, which can affect the process.


    There are the following streams:

    • Low Wage 
    • High Wage 
    • PR Dual Intent 
    • PR Support
    • Global Talent

    Depending on the chosen stream, the process may be either complex and lengthy or more straightforward and expedited. 


    These factors also influence the LMIA processing time and associated fees.


  • Fees and Processing Times

    Employers seeking to hire a temporary foreign worker can generally include the cost of obtaining a Labour Market Impact Assessment (LMIA) as a business expense. LMIA-related fees may include:


    • LMIA Processing Fee (CAD 1,000 per position)

    • Costs for advertising the position

    • Administrative expenses for preparing and submitting the application

    • Legal fees if an immigration professional is hired to assist with the LMIA process


    Not all cases will incur every fee listed above. There are situations where employers might be exempt from LMIA Processing Fees and provide details on other expenses involved in the LMIA process.


    Processing times can vary significantly based on several factors, including the LMIA stream, the specific job (NOC), and any applicable pilot programs with ESDC.
